Resumo: |
The present work approaches the “urbanistic permits” (building permit), from the point of view of urban politics, aiming at verifying which aspects and characteristics are manifested in its legal regime. Researching the main doctrine and legislation, the study starts from the identification of the development of urban control in the cities, giving a brief overview of “urban control” activities in Brazilian Law, highlighting the competences defined at constitutional level and the guidelines brought by the Federal Law n. 10.257 / 01. Considering the absence of legal definition, it will be developed a proposal for conceptual delimitation of urbanistic permits, showing its distinctive trait and verifying the principles and values involved, its legal foundations, species, and the peculiarities of the discipline. It will be highlighted the importance of the figure as the main instrument of control of material interventions in the city, through which urban limitations defined in the local plans are concretized, for the transformation and qualification of urban settings, always in line with urban policy objectives drawn at constitutional level |
