Resumo: The definition of sport is not unanimous, but defining sport is essential to establish the legal standards to be adopted and provide stability to legal relationships arising from sporting activity. Sport has evolved and undergone several transformations throughout its history, and its concept must follow these changes and must be constantly updated according to social, educational and cultural factors of each era. This results in the need for a definition capable of reaching esports, which involves the distinction between game and sport. The right to sport and its promotion are provided for in the Brazilian Constitution, and sport must be recognized as a fundamental right, in the same category as education, culture and leisure, as it constitutes a pillar of the Democratic Rule of Law as a manifestation of the Principle of Human Dignity . Esport needs to be an integral modality of physical education classes which, together with training sport, will serve as an instrument for implementing fundamental rights, basing its social function on this. The responsibility for the inclusion and development of electronic sports in education lies with society and the State, imposing, for this purpose, the leading role of modern homo sportivus
