This dissertation seeks to analyze the Brazilian special procedure called third party defense in a critical manner, taking into account its legal discipline encountered in the revoked Law 5.869/1973 and in the new code of civil procedure (Law 13.105/15). The present procedure code modified the legal discipline of the institute, changes which relighted the discussions about the third-party defense, especially regarding its legal nature, purposes, judicial cognition, sentence and res judicata. The thesis starts with brief notes of the procedures, correlating them with the species of judicial cognition which can be carried out. Then, the main features of the legal action are examined, such as legal nature, legitimacy and procedural course, seeking to understand the action in accordance with the novel paradigms of introduced by the new code of Civil procedure, taking in account the historical of the action and the jurisprudence of the higher courts. Finally, is examined which questions can be subject of cognition by the judge of law, considering in particular the effects of the changes promoted by the Law 13.105/15 regarding the res judicata and its extension |
