Resumo: |
The general purpose of this dissertation is to show the inexistence of bis in idem in the enforcement of sole triple environmental responsibility, besides providing specific reasons to apply each of the responsibilities, be them administrative, civil, and criminal. The methodology used was based on the research of doctrine, laws, and jurisprudence on the subject, following the line of general concepts of administrative, civil, and criminal law. Eventually, these concepts should be put together to simultaneously place the responsibilities. Finally, it presents the justification for the triple responsibilization, also based on the express constitutional commandment, so as to dissolve any questions about the simultaneous applicability of administrative, civil, and criminal responsibilities |
