Resumo: |
The objective of the present essay is to study the rigth of the human organ transplants as a right of the personality, analysing, in a sense, the medicine improvement through the transplants procedure, and considering, as the other side, the human conformation, and his importance in our juridical system, focalising in the principle of dignity as a human being. Many juridical questions are brought to light whenever it is relationed the question of the human organ transplants with bioethic, medicine and law, ressaulting that the main point is related to the right of life and the human integrity. In this sense, does the human organ transplant right take part in the personality rights? Could the phisicians vulgarize the aplication of this terapeutical measure to maintain a presumed common welfare? Is it possible to make the compability between the atual legal system and the cientific evolution? |
