This research discusses the existence of a legal basis in the Brazilian legal system for implementation of metropolitan master plans, the legal standards that discipline its content, the authority responsible for their enactment, their incidence boundaries, goals and objectives. In addition, it addresses the compatibility between metropolitan and municipal urban planning. The aim of this study is to further the identification, within the Brazilian legal system, of the rules that relate to the organization of urban planning of the metropolitan areas. The proposed thesis refers to the legal regime of the Metropolitan Plan, made up by a set of principles and rules governing the urban planning of public functions of common interest. For this purpose, this work investigates the legal nature of metropolitan planning the typologies in which metropolitan plans are framed, the legal basis authorizing their enactment and the federated entities competent to enact them. The investigation methodology is grounded in current legislation as well as in specific cases analyzed by the judiciary. It seeks to respond if metropolitan plans are elaborated on account of compulsory ties between the state and the municipalities or connecting links, also approaching the drafting and approval processes, the parties involved to define the content as well as the parameters to face the conflicts between metropolitan and municipal master plans . Furthermore, the survey covers the territorial boundaries governed by the plan, its objectives and purposes, the period for review and the legal standards applied by reason of the revocation of a master plan by another, taking into account the rules of Brazilian intertemporal law |
