This dissertation promotes a discussion about the creation of truths in the criminal law discourse from rhetoric and discursive perspectives It has as a corpus an assassination crime occurred in the São Paulo city in which the husband is suspect of killing his own wife In order to provoke a coherent linguistic debate it is used as the theoretical base the New Rhetoric especially as described in the studies of Chaim Perelman & Luci Olbrechts-Tyteca Michel Meyer and Olivier Reboul focusing argumentative aspects of the law discourse It also uses the studies of Michel Foucault emphasizing the power relation created in/by social and interpersonal relations which emerge from the discourse
