Resumo: |
The purpose of this paper is to open discussion about the legal effectiveness of individual negotiation in order to prevail over the legislated, and the negotiated collectively, in terms of the sole paragraph of art. 444, of the Consolidation of Labor Laws. The purpose of this paper is to address the application of labor law principles as well as constitutional principles in order to verify the effectiveness of the individual negotiation of the "hypersufficient" employee. The present study also addresses the offense against the 1988 Constitution regarding the possibility of individual negotiation prevailing over legislated and negotiated. The dissertation in question sought to bring the dogmatic view of Labor Law, due to its essence and nature, the possibility of facilitating individual negotiation in favor of modernizing labor relations, and seeking more jobs |
