This research is about the theme The Political Education as a minimum vital standard of the right to education in the 1988´s Constitution . Involve the right to education construction as a fundamental and human right that brings the complete person development, his prepare to the citizenship and job qualification. This human and fundamental right, that gives this social empowerment, has the scope of develop his cognitive, motor, mental and spiritual abilities, change him in critical thinking being, in order to rationally participate in a democratic regime that is, on the other side, the unique regime efficient for this human development. So, we are indicating that the right to education, as a fundamental, social and state provider right, like is disposed at 1988´s Constitution statements, can be a fact if contains the unconditional and minimum vital standard, that establish the commitment to the human dignity protection, even if changes made in the socioeconomic or organization of the State. And the real essence of the right to education as disposed at 1988´s Constitution, involve the base line to be gotten in the educational process give to the Brazilian citizens at the schools, including an active and dynamic citizenship experience, that however is delivered in an informal and intended instruction, and doesn t be able to change the Brazilian citizen in an active person. It is opposed to the objectives of a right to education as a right of all, that presupposes an equal and citizen education, to be given in accordance with the differences between the Brazilian citizens. So, we are pointing a formal and intended education, made in a dialogical process, gives as an interdependent discipline, since the first age, to permit the knowledge and the habit of a Social Democracy for the Brazilian people, using the statements of the 1988´s Constitution. This declaration gains strength when is taking a systemic interpretation of the 1988´s Constitution, specially the 205th article and the 64th article at the Acts of Transitional Provision |
