This work aims at the study of judicial protection collective. Firstly, tried to define the categories of overindividual interests, highlighting the action as a civil public guardianship differently. Then tried to pinpoint the history of the law of civil public action to subsequent legislation. The object of the action civil public was limited itself and, finally, have been identified procedural aspects of collective authority. The collective interests lato sensu always existed, however, were previously in charge of Public Administration and today gained importance, to the point of becoming their supervision required by the court. The process is a tool and as such, has value if it is able to fulfill its purpose, allowing the proper application of the law subjective, so as to promote peace with social justice. At this point, demand collective provides the effective judicial protection of the overindividual interests. The evolution of the process is patented in the Brazilian collective examination of the existing legislation, which is seeking, every day, the recognition, protection and deployment of instrumental collective judicial supervision. In the examination of procedural issues of collective process, tried to emphasize that the assumptions valid for the individual actions are insufficient to enable the appropriate size and operation of the collective demands in order to reach the end intented |
