This work addresses, in an interdisciplinary way and from the point of view of Civil Law and Gerontology, the autonomy, the aging and the way these institutes are treated in judicial decisions related to the legal business of marriage, stable union and disposition of the patrimony, which involve the elderly. For its elaboration were carried out readings of theoretical references on the autonomy and the aging, studies on the legislation and the survey of cases judged by the Superior Court of Justice and the Court of Justice of the State of São Paulo, from 2015. The survey of cases allowed the selection of some decisions, which were analyzed and led to reflections on the subject
