Resumo: The objective of this study is the analysis of the relationship between leisure and tourism in the consumer society under the perspective of contradiction between the promise of happiness and business in times of globalized capitalism. In this perspective, the present study focuses the meaning of leisure, having and not having leisure in the contemporary society and what interfaces can be established among suffering, frustration and discomfort in the relationship between the tourism agencies and the tourist when his expectations are not met and damages and losses are caused. It also questions the consumer rights in that context. It refers to a historical and sociological investigation based on literature revision, documented survey and theoretical discussion, as well as the analysis on themes such as leisure, tourism, work, discomfort and suffering in the contemporary society. It intends to contribute for the comprehension of the various entertainment forms, specifically concerning tourism in the context of a market society that trades relations, and for the understanding of leisure as a concept that was built from the emerging urban-industrial society, discussed from the changes occurred in the society upon the latest capitalism and globalization requirements, tension and sorrow that characterize the relations, when the individual faces freedom to choose what he considers the best to himself and to decide what he wants, specially when he deals with the so-called consumer society. This investigation is also based on risk reflection, insecurity, uncertainty and suffering in the contemporary society, bases for the discussion on leisure, mainly on tourism, as an economical development factor to reduce social differences, as a complex social phenomenon by the positive and negative impacts it generates, as a compensation to escape the stressing and overwhelming routine, socially produced by the same society that stresses and overwhelms, offering risks, insecurity and danger. Therefore, the present study tries to disclose the contradictions that are in the base of the consumer society and the intensive trading relationships framed by the possibility of protection offered by the law, specially the one that protects the consumer rights
