The present work aims to bring to light the evidence that the communication between the State and the social system is distorted, with the autoimmune crisis, in the terms of Willis Santiago Guerra Filho, that plagues us. Using the thought of Walter Benjamin and his notion of Erfahrung (crossing), as well as the critique of the mythology of sovereignty and the theory of social contract, supported by the theory of social system developed by Niklas Luhmann, we intend to show the need for a behavioral change through overcoming the growing self-isolation of individuals and the social systems their communication produces to become possible, and then it turns out to be impossible. The objective was to demonstrate the need to rethink the State and deactivate its current use, thus seeking to get out of the non-human forms of currently existing relationships, in order to guarantee the effectiveness of Law and fundamental rights, recovering the (im)probability of communication
