Resumo: Study about psychosocial risks related to work and the realization of the fundamental right of protection to workers’ health against this types of risks, being a theoretical study with objective to understanding the composition of this right specifically against that type of risks, under a perspective of realistic theoretical hermeneutic of fundamental rights and how that right is thus realized according the juridical system. The problematic of research involves a dilemma between the existence of these risks to health of workers in inexistence of adequate and sufficient regulation of Public Power to prevent them, and a set of the constitutional and international precepts defining the rights of protection to workers’ health, but seeming not to produce an effectiveness against risks of this type in reason of the reported lack of regulation. Methodologically, this study is a bibliographic and theoretical research, and with deductive reasoning, but before also using inductive reasoning only for the formulation of the reported specified fundamental right as a major premise. This study concludes that the standards, resulting of pacified scientific knowledge that reveal the phatic and social existence of psychosocial factors and risks related to work, can influence the realistic interpretation and application of fundamental labor right of health protection against these types of risks, including in situations of omission of regulation of the Public Power about this matter, but without the same reach and precision that this regulation can attain
