Resumo: The objective of this essay is to demonstrate the importance of the Principle of Publicity towards the concretization of democracy in front of the power system. For this, we delined a brief scenery of the brasilian military dictatorial period in order to demonstrate the first fase of the process of democratization transition from the dictatorial regime to democractic regime and that the second fase consolidation is not concluded. We concepted the term principle to emphasize its importance in the legal system and we delineated the Democratic Principle as structuring or politicalconstitutional, therefore dependent on other principles or sub-principles for its implementation. Considering the existence of the interrelationship and the interdependency between the principles, we analyzed the Principles of Legality and the Supremacy of Public Interest; we discoursed about the Principle of Publicity as intrinsic to democracy and we passed to the fundamentals rights of truth and of information as logic developments of that Principle. Then we developed an explanations about the power system and its implications in actual society, like the individualism that leads to the loss of public space, and the occultation of informations that places us in a scenary where the democracy loses its strength. The result of all analysis was the confirmation of the relevance of the Principle of Publicity to make the people conscious of its role as citizen and that it is necessary to combine the people conscience with its mobilization to consolidate the democracy
