Resumo: |
The present work aims to demonstrate that employees, with the aim of committing fraud, when in a typical employment relationship, often use the hiring free of labor rights, that is, they transform a true employment relationship into a simple contract of work of labor, among different qualifications, aiming to defraud the labor rights that should permeate the employment relationship, given that this os the main objective of labor law, that is, the protection of the hypo sufficient, in this case the employee. To reach where labor law has reached, in the country’s legal system, many battles and discussions have taken; however, the contracting companies of this legal relationship try to distort the classic labor pact, and it is up to the Labor Court to analyze each case in a concrete way, preventing such circumstances from contituing to be practed |
