A superlotação carcerária e a indignidade da pessoa humana: a seletividade do sistema penal brasileiro

Resumo: This work aims to analyze the current crisis in the Brazilian penitentiary system, considering dogmatic studies of Criminal Law and Criminology, through the Theory of Labelling Approach. The massive violation of fundamental rights of imprisoned people in Brazil is a subject already acknowledged by the Federal Supreme Court in the Claim of Non-compliance with a Fundamental Precept n. 347 (ADPF n. 347), judged in October 2023. This study is supported by bibliographical and jurisprudential research, scientific papers, academic works, and official reports from the Federal Government and the National Council of Justice. Initially, historical views about the theory of punishment and its evolution will be addressed, to demonstrate that the punishment of a person who committed a crime is still far from abandoning the purpose of revenge. Next, the constitutional framework focused on respect for human dignity is studied. If, on the one hand, the State’s legitimacy to punish is limited by constitutional rules that guarantee the fundamental rights of incarcerated people, on the other, these people, even before imprisonment, are already marginalized, according to various social markers, revealing that human dignity no longer has been a right assured to them by the State. The issues of persecution of the poor and structural racism will be approached to indicate that official government statistics reflect, in the context of prisons, exactly what happens beyond their walls, characterizing the selectivity of the penal system. Considering the scope of the Judiciary, finally, a critical study of ADPF 347 will be made, analyzing the administrative measures implemented after the judgement of this lawsuit by the Federal Supreme Court
