The purpose of this study is to analyze the appropriateness of the appeal against the New Code of Civil Procedure. For that, four chapters were developed, the first two introductory and to establish premises and the last two specific of the theme. The first chapter outlines a brief historical evolution and deals with the principles applicable to fit. The second chapter deals with the interlocutory decisions and their content, since it is the object of contesting the grievance of an instrument. The third chapter deals with the admissibility of the Aggravation of an Instrument appeal, with a focus on the adequacy of the instrument. Finally, the fourth chapter deals with the form of challenging interlocutory decisions, focusing on the aggravation of an instrument provided for in the Code of Civil Procedure
