The object of this doctoral dissertation deals with the combination of full protection, social protection and socio-legal protection in socio-educational measures in the open, typified as part of special social protection of medium complexity of Suas (Social welfare national unified system). The hypothesis is as follows: the separation between full protection, social protection and socio-legal protection leads to fragmentation and not to the strengthening of the defense of the adolescent's rights and weakens his/her status as a subject of law. Although socio-educational measures in the open have been allocated to Suas as a demand of social protection, there is a lack of dialogue between the area of Social Assistance policy and the socio-legal area in the affirmation of social protections for adolescents complying with socio-educational measures. Based on personal experience and the services provided by Cedeca Sapopemba in the area of social-educational measures in the open, we seek to identify the manifestations, present and absent, of social protection for adolescents, responsible for the offense, who are attended by these Services. It is also intended to understand how social protection and full protection have been incorporated into the Child and Adolescent Statute (ECA), how they apply to socio-educational measures and how Suas and the Justice System act to ensure these protections as the systems that account for social and educational measures in the open environment. The work will be based on bibliographic research, document analysis and field research, which is qualitative in nature, conducted with interviews and focus groups. As a result of the proposed study, alternatives will be pointed out that can contribute to ensuring social protections for adolescents and their families from the perspective of full protection. For this horizon is not yet an achieved concept in Brazilian society, but a goal to be pursued with confrontation with its opponents |
