This master thesis is focused on the right to attend the funeral rites of incarcerated people. The importance of funeral rituals for processing loss is within the theme of grief and its repercussions. This right is discussed from a fundamental right perspective and is part of the process of humanization of the prisoner. The impasse in realizing this right exists because the institution of exit permission does not have instruments in the Penal Execution Law nor in the factual reality of prisoners having the right to enter the mourning process through attendance at farewell ceremonies. The choice of the legislator to provide this institute in the LEP allows the exercise of discretionary power by directors of prison establishments, which must be resolved by the imposition of the verb “shall”, in order to ensure legal certainty in the postulation of this right. As a solution, it is suggested the implementation of a paragraph in this article so that a thorough assessment can be made of which prisoners whose state of freedom requires greater organization of the police forces |
