Resumo: The present work search, in a conception based on the Democratic State of Law and grounded on human dignity, to trace the changes that are taking place gradually in Criminal traditional dogmatic in trying to combat new forms of crime, approaching topics such as the supposed crisis that is affecting this branch of law, the possible solutions suggested by authors recognized worldwide, reaching to the analysis of the legitimacy of the flexibilization of some of the constitutional warrants pillars in the search for effective public safety. As a result of an emergency way that has been operating in Brazilian Legislative Power, and in the search by supplying the gap between the speed of development of science and the brazilian legislation, arises the Law of Biosafety, which will be analyzed the criminal aspects since the philosophical and constitutionals foundations that legitimize the criminal law intervention because of the collective goods and interests legally protected, to how the matter is treated in the international arena
