This dissertation work has as main objective the identification of protective guardianship and autonomy of indigenous peoples present in the Federal Constitution of 1988 and the infra-constitutional norms and international standards. To this end, part of the detailed research on Social Rights and historic legislation on the rights of Brazilian Indians, from the colonial period to the enactment of the current Constitution.
