Children's juvenile rights have long been neglected. The trajectory of winning these rights had been arduous and marked by a series of relevant episodes so that Brazilian children and young people could reach the condition of differentiated individuals. Even so, what is evident, especially after the consecration of the principles and guarantees set out in the Statute of Children and Adolescents, is a real crisis in the juvenile punitive system. Faced with this crisis, the debate about alternative measures falls, precisely, on the institute that has the most promising: the Restorative Justice. The study will contribute to highlight the benefits of applying the restorative system to the detriment of retributive in the scope of juvenile justice, making a brief analysis of the socio-educational measures used today as a result of offenses committed. The objective will be to highlight the possibility and, still, the need for coexistence between these two criminal systems, so that the rights and principles conquered can be guaranteed and, above all, to seek a restraint to recidivism, to the increase of acts offenses and, bringing the young offender’s concrete re-education and, ultimately, to a social appeasement |
