The youth in conflict with the law sets up as a social phenomenon that has attracted special attention from the field of scientific knowledge, the society and the authorities responsible for implementing of public policies. This social issue is the focus of an intense debate about the rights and duties of this "population" in its relationship with society. To understand this current field of dispute, we begin, therefore, analyzing the social treatment proposed for teenagers who committed crimes. This analysis seeks to understand the legacies inherited in traditions systematized in the brazilians Códigos de Menores (drafted in 1927 and 1979), for the several "irregular situations" that were framed in these teenagers. Such thinking underpins the analysis about the ambiguities and tensions still found in the text of the Statute for Children and Teenagers (Estatuto da Criança e do Adolescente), whose consequences are felt in the implementation of the measures proposed by it, especially when considering the turbulent field of interventions aimed at teenagers in conflict with the law which until today still divides opinions of lawyers, academics, human rights activists and civil society itself about its criminal and pedagogical character. This understanding of ECA‟s legal and conceptual landmark gain in consistency with the conceptual analysis, based on Foucault, about the knowledges and practices developed by distinct governamentalities, which are based on control of individual bodies, by disciplinary mechanisms, and on regulation of populations, by biopolitical mechanisms of security. Analyzing scenes experienced in a service of socio-educational support in Sao Paulo and cases of teenagers in conflict with the law, this research proposes an interpretation of socio-educational intervention that aims to contribute to an ethical-political thought about the effects of socioeducational practices in the daily lives of these teenagers, effects of conduct's normalizantion, effects of resistance. In what terms the socio-educational intervention may raise responsibilization and strengthen freedoms and ethicalpolitical resistance? |
