Resumo: | Given the intense social movements calling for democracy in full democratic state of law, something seems poorly explained. How the demands of a pluralistic, multi-center and post-modern society can be met only by reading the Civil Code of 2002? It would be the sparse legislation coupled with microsystems a viable solution to cover the entire socio-legal phenomenon? Issues such as homoafetivas unions, reassignment, poliafetivity, adoption of children by same-sex couples, biosafety, abortion, family violence, child custody, freedom of religion and expression can only be circumvented with the syllogistic method? In this area you will find the present work, that is meant to question the axioms of the classic civil law in the desire to seek the best possible synthesis for a systemic-constructive hermeneutics which is guided by the principles of citizenship and human dignity. |
