Resumo: This thesis discusses the general rules laid down in the article 24 of the Constitution of 1988. It argues that the defice in focus has been interpreted from the perspective of a conservative hermeneutics which does not reflect adequately the value choices of our Constitution. From a perspective inspired by the cooperative federalism, the work suggests it is feasible to estabilish formal criteria and materials that contribute to harmonizing a reading of the condominium legislation introduced by the 1988 Federal Constitution. The details of the Constitution, in the relevant standards to be observed by the public service pension scheme, reduce the space for the establishment of general rules on social insurance law, but does not eliminate the need for their production. After criticizing the choices of the Federal Legislature, the thesis indicates some themes that set a minimum substrate that can be detailed by the special kind of Law in order to assured a uniform federal standard in social security.
