Resumo: Linked to the Criminology and Social Control research line of the Pontifícia Universidade Católica do Rio Grande do Sul’s Graduation Program in Criminal Sciences, this dissertation analyses the matter of “criminal organization”, from criminal dogmatic’s, criminology’s and criminal policy’s points of view. This research was conducted through an exploratory and critically descriptive mode, based on literature and jurisprudential analysis. The chosen approach methods were both deductive and dialectical. Therefore, in the first chapter, the context in which the legislation about “criminal organization” was created is characterized, going through some aspects of the expansion of criminal law, modernity and economic globalization, considering feelings of “fear”, “security” and “risk”. In the second chapter, the entity “criminal organization” is analyzed, considering its presence in national and international legal system (principle of legality). The last chapter focuses on verifying the superior courts’ (Superior Tribunal de Justiça e Supremo Tribunal Federal) jurisprudence, from which it’s possible to see the difficulty of dealing with a crime without concept, without criminal type delimited.
