Resumo: The main objective of this research is to present the basis given to the establishment of the Labor Right by Positivist Aposcleship and “Castilhanism”. Thus, the study was based on the conception of the Right as a social and historical building that incorporates nowadays believes and clash of ideologies. The analyses focus the end of the slavery abolition as well as the first days in the new type of government that was the Republic system. We highlighted not just the constitution of the first labor laws in Brazil, but also the perspective that work was seen in the transition of slave work to the one that was done freely. We believe that the contribution of those two segments to the Brazilian Positivism occurred in the juridical fields when “Castilhist” Constitution was inscribed into the labor nature rule, and also when the symbolic process broke the stigma that work had in the century in which slavery was happening.
