Resumo: | The aim of this study is to analyze, through the doctrine, the binding sumula institution. This dissertation is divided into six chapters, including the introduction. The first one points out the scientific basis for an ideal jurisprudence uniformization, taking into account for that the human capacity to feel and interpreter the facts and rules linked to the biographic datas from the interpreter. The constitutional ground for that has also been considered, as it brings the material equality perspective as a search for isonomy in the law making process. The second chapter deals with the legal nature of the judicial precedent, and its creative function or merely the declaration power of the precedents. It also developes the historical evolution of the jurisprudence uniformization, within the aim of constructing an unique body of jurisprudence since the imperial times. The third chapter also discusses classifications of the judicial precedents in relation to its bindness. The factors that determine the rate or the grade of persuasion also has been mention as well as the grounds for this binding effect. The fourth chapter brings an overview of the english and north-american judicial organization and the appliance of the precedent in that systems. The ordinary sumula, jurisprudence uniformization and the sumula that avoids appeals are the matters of the fifth chapter. The sixth one explores the inquire about the binding precedents in the Brazilian system, among them the binding sumula and all matter related to that. It is important to make clear that this research make possible the request to the Supreme Court to enforce that. |
