This study intended to examine a specific aspect concerning the correlation between the maxim of proportionality — in it’s double dimension of “prohibition of excess” an “prohibition of insufficiency” — and the effectiveness of the fundamental right of effective judicial protection. After brief considerations on the contemporary notion of fundamental rights in the brazilian democratic state and on the dynamic of their normative effectivation, was given emphasis in a theoretical approach to the applicability of the refered maxim and of it’s relying standard of normativ balancing regarding the solution of the fundamental rights’ collisions taken upon the judicial promotion of the suitability of civil law procedures to the goals of the substancial right.
