Resumo: The objective of the present work is the analysis of the recent presence of foreign groups in Brazilian higher education, focusing on the legal apparatus that legitimized such commercial presence, using the Laureate/FMU case to study. This research intends to answer the following question: What are the ideopolitical links and legal-juridical forms that enabled the participation of foreign groups in Brazilian higher education? This question led us to pursue the following general research objective: To understand the juridical-legal forms that, in the process of contemporary reconfiguration of Brazilian higher education, promoted the adequacy of institutions of higher education to meet the political-ideological demands of legitimation of capital in this sector of national education. To achieve this general objective, we pursue the following specific objectives: a. analyze ideopolitical discourse and agenda and respective institutional agents that legitimized the presence of foreign educational groups in the country's higher education; B. to analyze the evolution of educational, constitutional and infraconstitutional legislation, which culminated in the configuration of a higher education market and legalized the participation of foreign group investments in national higher education. He research was done based on i. documentary analysis of the legal structure that established and organized the Brazilian national higher education system and the universe institution of this research - Federal Constitution of 1988, LDB/1996, infraconstitutional legislation that regulates higher education in the country; social contract sales contract; and ii. a bibliographical analysis that discusses the contemporary context (1988 to 2017) of a political-ideological formulation that proposes the privatization of higher education based on strategies of commodification and transnationalization, especially those contained in documents of multilateral organizations (WB, OECD, WTO) , academic literature and theses, dissertations and scientific articles. This is a research of a theoretical and empirical (documentary empiria) nature that seeks to highlight the relationship between the recommendations of reconfiguration of policies and systems of higher education focused on the commercial privatization and the creation of a legal apparatus that favored and legitimized it, although its constitutionality is doubtful since this system leaves in doubt if the education is really a fundamental right of the citizen or only a commodity. Commercial privatization and transnationalization are the central categories of this research.
