Resumo: The right to same-sex couples constitute family was legally built in Brazil through a judicial process after a series of gradual movements of the Judiciary, which first equated the civil homosexual union with the heterosexual union, then recognized the absence of impediment to the same-sex marriage and, lastly, issued a normative regulating this kind of marriage for the notarial services and members of the Judiciary. Parallel to this movement, Congress discussed legislative proposals on the same subject, but no project has been approved so far. In the movements carried out by the Judiciary and Legislative Branches different family concepts were used and normative competencies and institutional functions were mobilized. The analysis of the content and the form of these movements is the object of this dissertation, which includes the discussion of the same-sex marriage and family in the Judiciary and Legislative Branches, submitted to the Academic Master's Program of the Sao Paulo Law School of the Getúlio Vargas Foundation (FGV Direito SP), in the area of concentration Law and Development, subarea Institutions of the Democratic Rule of Law and Political and Social Development.
