This paper intends to describe the composition of the regulatory space of the Brazilian Electrical Sector and the coordination of the activities performed by its members. Regulatory space is understood as the metaphor used to describe the actors and their interactions in the performance of the regulatory function of a given sector. It will be seen that the regulatory space of the electric sector is characterized by relations of great interdependence between state and non-state actors. It is believed that the better understanding of this relationship among the members of the electric sector is important to ensure a more effective regulatory action. To achieve this goal, the paper was structured in three parts. In the first, it will be revised the concept of regulatory space and the regulatory theories that help in the description of the characteristics of the regulation of the electric sector. It will be seen that regulation of the sector is not based exclusively on traditional regulatory techniques and counts on the participation of non-state actors. In the second part, the process of forming the regulatory space of the electric sector over time will be reported in order to facilitate the understanding of its current structure. The description of the current structure of the regulatory space, with its main actors and attributions, is the object of the third chapter. In the fourth and final chapter, it will be analyzed some of the regulatory processes conducted by the main actors of the regulatory space of the electric sector. In order to describe the regulatory space of the electric sector, this research had a bibliographical review on the theory of regulation and the Brazilian Electric Sector, besides an analysis of laws and especially documents that portray the relations of interdependence of the actors involved in the regulation of this economic sector. In the end, it will be seen that, despite hierarchical organization and state intervention, the evolution of the electric sector has demonstrated the need for less vertical relations based on cooperation and coordination between public and private actors. Understanding and improving this characteristic is, therefore, essential for proposing improvements to the internal relations of this regulatory space and guaranteeing greater effectiveness to its regulation. |
