The research is about the temporary effects on judicial review, when constitutional rights are not respected. The study aims at analyzing article 27 of Federal Statute n° 9.868/99 and article 11 of Federal Statute n° 9.882 /99, which establishes other temporary effects besides ex tunc effect, the tradition in Brazil. The problem was analyzed by a dogmatic view, using analytical method and the pure theory of law as a theoretical reference. Concepts of general theory, constitutional law and the judicial review in Brazil were analyzed and related to North-American and Austrian models of judicial review. After the analysis of the Brazilian law, the study concluded that the ex tunc effect predominates in the Brazilian judicial review. However, non retroactive decisions, including when constitutional rights are not respected, are possible and sometimes necessary.
