Resumo: After overcoming the scientific phase, the Civil Procedural Law faces the effectiveness age, because it was concluded that the procedure only exists due to the affirmation of the right injured or threatened of injury. Now, the instrumentality tends to connect the procedure to the substantive right, because it is from the substantive right relationship that appears the procedural right relationship. In order to achieve the expected results, besides forecasting the instruments of guardianship adjusted in law, it must be essentially simple and agile, establishing a commitment of the participants including the Attorney General’s Office. The excess of accumulated attributions by the Attorney General’s Office in the civil sphere, is a result of the undertaken effort to tutor new emerged interests with the complexity, the urbanization and the globalization of the modern world, on one hand brought up the Institution, but on the other hand became less agile and more congested, hindering the adequate attendance of all the required demand. Due to this fact, it is necessary that the Attorney General’s Office of Century XXI rationalizes, as fast as possible, his performance in the field of the civil action, adjusting it immediately to the best attendance of the society interests and avoiding the practical of the unnecessary procedural acts, in order to guarantee the procedural effectiveness. Therefore, the Attorney General’s Office has the obligation to choose priorities and establish goals for achievement of its needs, acting exclusively in the cases that public interest purpose to be tutored by the Institution, in proper order of the Federal Constitution. This study does not have the pretension to deplete all the variants that involve the subject, but intends to focus the most important aspects, bringing doctrinal and jurisprudential references that regards.
