Resumo: This research deals with public policies on higher education in Brazil, with a focus on the regulation of regulation and supervision of undergraduate courses. Thus, the aim of this study was to identify and analyze the socio-legal framework of Higher Education that guides the regulation, supervision and evaluation of Higher Education institutions in Brazil. An exploratory and qualitative research was carried out, using the resources of bibliographic review on the theme “regulation of Higher Education”, as well as the document analysis technique systematized in Decree nº 9.235, of December 15, 2017, which provides for the exercise of the functions of regulation, supervision and evaluation of institutions of Higher Education and of undergraduate courses in the Federal Education System. The literature review resource helped to delimit the theoretical framework of this study (CARNEIRO; NOVAES, 2008; SANTOS, 2019; SCHWARTZMAN, 2015; VERHINE, 2015; WEBER, 2010). The development of this research made it possible to identify and systematize the legal documents dealing with the regulatory acts of regulation of Brazilian Higher Education, highlighting the central role of the National Education Council, which establishes the principle of the unprecedented evaluation and regulation process in Brazilian education. Regulation, as a management tool, can be understood as an exercise used in the investigation, monitoring and diagnosis of Higher Education, which is aimed at a set of laws, standards and determinations, which aims to control the functioning and quality of Higher Education. At the same time, it is possible to learn, within the scope of the Federal Education System, the legal requirements for granting the opening of a higher education course, as provided for in Decree No. 9,235 / 2017. The expansion and development of Higher Education policies, beginning in the 1990s, were characterized by a new standard of regulation of such policies, in which the control exercised by the State gained centrality through the evaluation, financing and planning devices, making it possible to decentralize the offer of vacancies through private Higher Education Institutions and the increase of vacancies and institutions in the federal public network. It is concluded that the regulation policies of Higher Education aim to promote "equal access conditions", "to guarantee the quality standard of institutions and courses" and "to stimulate the pluralism of ideas and pedagogical conceptions" and the “coexistence of public and private educational institutions”. In this way, it was possible to understand the procedure for the exercise of regulatory functions - through authorizing acts of operation of Higher Education Institutions and the offer of undergraduate and graduate lato sensu courses; supervisory - through preventive and corrective actions; and evaluation, through the National Higher Education Assessment System, with formative character, constituting as a basis for the regulation and supervision processes of Higher Education Institutions and the respective courses offered, whether these are in person or at a distance.
