الملخص: | The purpose of this paper is to analyze the legal regulation of automobile accidents from the Law & Economics’ point of view, aiming to find an alternative for the damage compesation. The amount arbitrated must be sufficient for the agent who caused the damage to internalize a consequence of his acts. One of the best alternatives to determinate the amount of the compesation is through the punitive damages, wich is arbitrated with the purpose to punish the conduct practiced, dissuading the offender to incurre the illicit practice in the future, as well as discouraging the members of society to adopt similar behaviors. |
