As decisões oriundas da 13ª Vara Federal da Seção Judiciária do Paraná foram publicamente discutidas pelos tribunais e pela comunidade jurídica, existindo certa compreensão no imaginário popular ligando a efetividade dessa apuração criminal às prisões preventivas e ao alegado baixo índice de revogação pelos tribunais de revisão. O garantismo penal, por sua vez, veio à tona ante as possíveis violações de direitos fundamentais dos investigados e, no caso das prisões cautelares, ganha especial relevância a presunção de inocência. Este trabalho está inserido nesse contexto e resulta da pesquisa quantitativa e qualitativa das decisões públicas de prisão preventiva proferidas na Operação Lava Jato entre 2014 e 2017. São igualmente estudados os acórdãos e as decisões dos tribunais de revisão e do próprio juiz da causa no sentido de revogar ou de substituir o cárcere no curso do processo por medidas cautelares menos restritivas. O marco teórico é o garantismo penal de Luigi Ferrajoli, teoria legitimadora do poder punitivo estatal, mas que busca racionalizá-lo e contê-lo, por meio das garantias penais e processuais penais. Sob esse prisma, é feita a análise de conteúdo das decisões, adotando-se o contato direto entre o pesquisador e os pronunciamentos judiciais por meio da leitura integral de todos eles. Do ponto de vista quantitativo, foi constatada a ampla utilização do fundamento da garantia da ordem pública nas decisões de prisão preventiva, o qual é fortemente criticado pelo garantismo penal. De igual forma, chamou atenção a revogação, pelos tribunais de revisão, de 32% (trinta e dois por cento) das prisões preventivas que fazem parte do espaço amostral, com destaque para a atuação do Supremo Tribunal Federal. Ainda nessa perspectiva, o próprio juízo de primeiro grau foi responsável pela substituição de um número considerável de custódias preventivas por cautelares diversas. Qualitativamente, ficaram demonstradas as várias justificativas utilizadas para preencher a hipótese legal de garantia da ordem pública, bem como a atuação do juízo de primeiro grau para fomentar as colaborações a partir da fundamentação das decisões concessivas de liberdade. Por fim, o argumento exposto para revogar o recolhimento domiciliar de alguns investigados apresentou flagrante contradição e indicou a utilização da medida como cumprimento antecipado de pena.The Car Wash Operation once again brought to the spotlight the decree of preventive detention in investigations involving economic criminality and the discussion on penal “guarantism” in Brazil. The decisions from the 13th Federal Court of the Judiciary Section of Paraná were publicly debated not only by Brazilian courts but by the legal community as a whole. Not rarely, the effectiveness of this criminal investigations has been linked to the usage of preventive detentions and the apparent low rate of revision by the higher courts. On the other hand, the issue of penal “guarantism” emerged in the face of potential violations of fundamental rights of those under investigation and, in the case of pretrial detention, the presumption of innocence gains special relevance. The present work fits into this context, and it is a result of quantitative and qualitative research of publicly available decisions related to preventive detention handed down within the Car Wash Operation from 2014 to 2017. Judgments by appeal courts and first instance courts that abrogate or replace the imprisonment orders with less restraining measures have been analyzed. The theoretical framework of the thesis is Luigi Ferrajoli’s penal “guarantism” - a theory that legitimizes the punitive power by the State, whilst seeking to rationalize and restrain it through the penal and criminal procedural guarantees. From this perspective, the content of the decisions was analyzed through direct contact between researcher and the relevant court rulings through the reading of all of them in full. In the quantitative point of view, it was possible to observe a considerable use of the public order argument to justify preventive detention, which is heavily criticized by the penal “guarantism”. Likewise, attention was drawn to the abrogation by the higher courts of 32% (thirty-two percent) of the preventive detentions in the sample space, with emphasis in the role of the Brazilian Supreme Court. The fact that the lower court itself was responsible for replacing a considerable number of preventive detention orders with different precautionary measures is also noteworthy. Qualitatively, the various justifications used to fulfil the legal hypothesis of public ordered were demonstrated, as well as the role of the lower court in encouraging the accession to cooperation by the person under investigation based on the grounds for decisions awarding freedom.
