O Sistema Jurídico Brasileiro ainda não encontrou uma solução regulatória para a nova modalidade. A partir de um estudo de teorias econômicas, é discutida a possibilidade de existência de um Sistema Monetário alternativo de maneira a especular como as regulamentações jurídicas brasileiras poderiam estar em conformidade com a nova tecnologia disruptiva. Comentários acerca do histórico e funcionamento da Tecnologia de Blockchain serão feitos para uma melhor compreensão das necessidades regulatórias. Almejando um foco na realidade prática, visto que se trata de um instituto abstrato e complexo, o estudo é estruturado a partir de uma análise comparativa com dois instrumentos monetários conhecidos e devidamente regulados: o papel-moeda e o ouro. Assim, será abordada a origem da moeda para compreensão do atual Sistema Financeiro Nacional. O intuito é desenvolver um sólido alicerce de conhecimentos econômicos para abrir caminho para análises mais complexas e profundas, evitando que sejam feitas fora de contexto. Por fim, será explorado o conceito jurídico de moeda, nomenclaturas para fins regulatórios e classificações jurídicas como Títulos de Crédito e Valores Mobiliários em face do Bitcoin. The Brazilian legal system has still not found a regulatory solution to the new category. According to studies of economic theories, the possibility of an alternative Monetary System is discussed in order to speculate how the legal regulations will match with the new technology. Comments on the historical background and the mechanisms of the blockchain technology will be done in order to understand the regulatory needs. Seeking a practical approach, even though it is an abstract and complex concept, the study will be organized from a comparative view of two well-known monetary instruments: fiat money and gold. Therefore, will be discussed the beginning of the currency to understand the current financial system. The goal is to develop a substantial foundation of economic knowledge in order to open branches for a complex and technical analysis, preventing studies beside the point. At last, will be explored the legal concept of currency, classifications for regulatory ends and legal categories as credit instruments and securities relatively to Bitcoin.
