Muito embora esse sistema funcione muito bem em acidentes corriqueiros ou danos eventuais onde as partes não agiram com má-fé ou não violaram gravemente e intencionalmente um dever de cuidado, sob uma perspectiva da análise econômica do direito e à luz dos conceitos econômicos aduzidos nesse trabalho visualiza-se um quadro onde o sistema meramente reparatório não cumpre a função dissuasória necessária para evitar algumas condutas danosas, mormente em situações onde o benefício econômico que um agente tem com a prática de uma conduta danosa é maior que a eventual reparação à qual terá de submeter. Nesse trabalho advoga-se não só pela possibilidade de implementação de um sistema indenizatório punitivo mas pela necessidade de tal mecanismo como incentivo econômico à tomada de precauções por empresas e indivíduos que, em determinadas situações, não são suficientemente compelidos a evitar uma prática danosa (que por vezes ataca direitos fundamentais da vítima) quando adstritos a um sistema de lógica meramente reparatória. ___________________________________________________________________________ ABSTRACTThe system of liability contained in the Civil Code of 2002 establishes the restitution to the status quo ante as a touchstone of this indemnity model , emphasizing merely the reparative nature of indemnity. Although this system works very well in everyday accidents or damage which the parties did not act in bad faith or not seriously and intentionally violated a duty of care , from the perspective of the economic analysis of law and in the light of economic concepts put forward in this work, we can see a framework where the reparatory system does not meet the necessary deterrent function to prevent some damaging behaviors , particularly in situations where the economic benefit that an agent has with the practice of misconduct is greater than the repairs to the view which must submit .
