Ainda, tais instrumentos não demonstraram ser suficientes e/ou eficazes para proteger e atender as necessidades das vítimas. Diante disso, a perspectiva nesses crimes não deve ser apenas retributiva, mas também restaurativa. Assim, surge a justiça restaurativa como uma forma de solução de conflito. O presente trabalho tem por escopo conduzir um estudo acerca do uso de práticas restaurativas em casos de violência doméstica conjugal (intimate partner violence). Verificou-se, de modo geral, a impossibilidade do uso dessas práticas neste âmbito no Brasil e em Portugal. Entretanto, na Áustria e na Finlândia são utilizadas práticas restaurativas através de victim-offender mediation em casos de intimate partner violence há décadas e, estas têm demonstrado resultados positivos. Conclui-se que diante das falhas do sistema jurídico tradicional no contexto da intimate partner violence, o uso de práticas restaurativas pode ser uma forma de solução de conflitos.Apesar dos avanços legislativos, tanto no Brasil quanto em Portugal, a violência doméstica não deixou de ser realidade nestas sociedades.
