Deste modo, debruçar-me-ei sobre os motivos que originam a necessidade desta tipificação, desde a dignidade penal do bem jurídico que visa proteger, ao risco que deriva de certos casos concretos que podem ser fatais para a vida intrauterina, nomeadamente a negligência médica e a negligência proveniente da própria mulher grávida. Irei ainda abordar o aborto negligente em comparação com o homicídio por negligência previsto no artigo 137.º do CP. Por fim, farei uma breve referência ao ordenamento jurídico-penal Espanhol que optou pela tipificação do aborto por negligência. O presente estudo versa sobre a problemática da não tipificação do aborto por negligência e visa abordar o facto de o legislador português não o elencar no catálogo de crimes previsto no Código Penal Português.
