Assumem particular relevo o regime do Código de Processo Civil, a Lei n.º 23/2013, de 05 de março e a Lei n.º 117/2019, de 13 de setembro. Através da análise dos referidos regimes, procuraremos identificar os principais problemas que surgem no âmbito do processo.É importante perceber quais são os casos que determinarão a instauração do processo de inventário, quem tem competência e legitimidade para tal, entre muitos outros aspetos processuais. O Inventário Judicial e o Inventário Notarial têm sido alvo de diversas alterações legislativas nos últimos anos, estando neste momento a competência dividida entre os tribunais judiciais e os cartórios notariais. Realizaremos uma reflexão sobre algumas opções do legislador, com o intuito de perceber até que ponto os direitos daqueles que intervêm no processo se encontram realmente protegidos.O próprio papel do Ministério Público, enquanto órgão que administra a justiça, tem sofrido mudanças significativas, principalmente no que diz respeito à sua legitimidade para requerer e intervir no processo. Neste contexto, faremos uma investigação essencialmente focada na competência que o Ministério Público tem para representar determinadas entidades no processo, nomeadamente o Estado, os menores, os maiores acompanhados e os ausentes em parte incerta, atendendo a todas as mudanças da lei nesse sentido.Tendo em conta as funções que o Ministério Público desempenha em várias áreas do direito, podem surgir situações de conflitos de interesses, em que o exercício de mais do que uma função se revela incompatível. Nesta circunstância, importa discutir qual das funções deverá prevalecer.With this dissertation we inted to analyse the legislative evolution of the inventory process, since the beginning to the present day. Take on particular relevant role the Civil Procedure Code, Law n.º 23/2013, of 05 March and Law n.º 117/2019, of 13 September. Through the analysis of the referred regimes, we will try to identify the main problems that arise in the scope of the process. It is importante to understand which cases will determine the beginning of the inventory process, who has the competence and legitimacy to do so and many other procedural aspects. The Judicial Inventory and the Notary Inventory have been the subject of several legislative changes in recent years, and the competence is currently divided between the judicial courts and the notarial services. We will reflect on some options of the legislator, in order to understand to what extent the rights of those who intervene in the process are actually protected. The role of the Public Prosecution Service, as the part that administers justice, has undergone significant changes, especially with regard to its legitimacy to request and intervene in the process. In this context, we will carry out na investigation essentially focused on the competence that the Public Prosecution Service has to represent certain entities in the process, namely the State, minors, accompanied adults and those absent it an uncertain part, taking into account all changes in the law in the regard. Taking into account the funcions that the Public Prosecution Service perfoms in various areas of law, situations of conflict of interest may arise, in wich the exercise of more than one function proves to be incompatible.
