A discussão em torno da definição, tanto na doutrina como na comunidade internacional em geral, parece interminável e pode ser explicada através da compreensão da evolução do conceito do terrorismo ao longo dos séculos. O terrorismo tem também rompido algumas certezas e manifestando influências no Direito Penal, como é visível no desenvolvimento da luta contra o terrorismo tanto internacional, regional e nacional. Com este trabalho pretende-se expor a discussão da existência de um crime de terrorismo contra o Direito Internacional, pois é necessária uma cooperação internacional eficaz para fazer frente a este crime e tal deve refletir-se na estabilização do terrorismo no Direito Internacional, o que demonstra a importância da constituição do crime de terrorismo como Crime Internacional Autónomo. Este entendimento não é unânime e depende da interpretação de diversos conceitos, assim como dos regimes jurídicos do crime de terrorismo nos diversos ordenamentos e no próprio direito internacional. Analisaremos a mutabilidade do conceito de terrorismo; as consequências jurídico-sociais que este fenómeno representa, as reacções despoletadas e a luta contra o terrorismo; o tratamento do terrorismo face ao Direito Internacional Humanitário, como sub-categoria de crimes contra a Humanidade; e por fim, o crime de terrorismo internacional como possível crime autónomo contra o Direito Internacional.Currently, international terrorism represents a great concern to the international community and, therefore, to International Law. The discussion around the definition, for both the doctrine and the international community in general, seems endless and can be explained by understanding the evolution of terrorism’s concept over the centuries. Terrorism has also breached some certainties and manifested influences in Criminal Law, as it is evident in the development of the international, regional, and national fight against terrorism. This work intends to expound the discussion of the existence of a terrorism crime against International Law since an efficient international cooperation is necessary to face this crime and must reflect in the stabilization of terrorism in international law, which demonstrates the importance of the constitution of a terrorism crime as a Discrete International Crime. The understanding of this topic is not unanimous and depends on the interpretation of an extensive list of concepts, as well as on the legal regimes of the crime of terrorism in the different legal systems and in international law itself.
