Pretendemos analisar nas linhas que se seguem, os traços fundamentais da instigação na ordem jurídica portuguesa, que se designa como uma das modalidades de comparticipação prevista na quarta alternativa, artigo 26.º do CP. Além disso, a importância de a mesma ter expressa consagração legal no artigo 26.º do CP, que se refere à autoria criminosa, por contraposição à doutrina alemã, em que a instigação surge como cumplicidade tida como uma forma de participação. Num primeiro momento, pretendemos demonstrar em que é que consiste a figura da instigação, referir as suas principais caraterísticas, da mesma maneira que, quando é que estamos perante um caso que se denomine de verdadeira instigação. Num segundo momento, o objetivo é estudar a temática da instigação, fazendo uma breve alusão à Época das Ordenações até ao CP de 1982. Por outro lado, trataremos de mencionar a sua evolução face ao CP de 1852, face ao CP de 1886, e finalmente, o nosso atual CP de 1982. Seguidamente, analisaremos a sua natureza jurídica, tal como, as diversas teorias para o conceito de autor, de forma a perceber e dar resposta à razão de ser, de como é defendida pela doutrina portuguesa. Em suma, trataremos de analisar a instigação que por muitas vezes é confundida com a autoria mediata na jurisprudência portuguesa, evidenciando como esta tem decidido nestas matérias.This dissertation aims to analyze deeply the evolution of the concept of instigation in the Portuguese legal system, as well as, the reason for being of the Portuguese law to determine the instigation taken as authorship. We intend to analyze in the following lines the fundamental features of instigation in the Portuguese legal order, which is designated as one of the co-participation modalities provided for in the fourth alternative, Article 26 of the CP. In addition, the importance of it has expressed legal consecration in Article 26 of the CP, which refers to criminal authorship, as opposed to German doctrine, in which instigation appears as complicity seen as a form of participation. At first, we want to demonstrate what the instigation figure consists of, to refer to its main characteristics, just as when we are dealing with a case that is called a true instigation. In a second moment, the objective is to study the instigation theme, making a brief allusion to the Age of Ordinations until the 1982 CP. On the other hand, we will try to mention its evolution in relation to the CP of 1852, compared to the CP of 1886, and finally, our current CP of 1982. Next, we will analyze its legal nature, as well as the various theories for the concept of author, in order to perceive and respond to the reason for being, as defended by the Portuguese doctrine.
