O mundo vem passando por um momento de intensa transformação digital com o uso massivo das redes sociais, aplicativos de comunicação e inteligência artificial. O aumento exponencial de utilização de novas tecnologias em todas as áreas do conhecimento humano é um processo inevitável que foi potencializado pela 4ª Revolução Industrial. Atento a este movimento, o Poder Judiciário (PJ) está gradualmente se adequando às transformações experimentadas pela sociedade moderna em decorrência do emprego generalizado da Tecnologia da Informação e Comunicação (TIC). Como resultado, observa-se o surgimento da denominada Justiça 4.0. Este estudo analisa o impacto do emprego da Tecnologia da Informação e Comunicação (TIC) no Poder Judiciário (PJ) brasileiro e seu paralelo com o direito português. Para atingir o objetivo desejado, foi realizada pesquisa exploratória na literatura e em documentos e sítios eletrônicos governamentais, com ênfase em legislação, valendo-se do método dedutivo, realizando-se ao final a confrontação de legislações correlatas. Em seguida, foi construída uma síntese comparativa. A análise possibilitou elaborar um quadro estabelecendo as semelhanças encontradas entre o código de processo civil brasileiro e o português. Constatou-se que os dois países estão empenhados na implementação das TICs em seus ordenamentos jurídicos e possuem inúmeros pontos semelhantes em suas legislações processualistas. PALAVRAS-CHAVE: Poder Judiciário. Direito Comparado. ABSTRACT The world has been going through a moment of intense digital transformation with the massive use of social networks, communication applications and artificial intelligence. The exponential increase in the use of new technologies in all areas of human knowledge is an inevitable process that began with the 4th Industrial Revolution. Aware of this movement, the Judiciary (PJ) is gradually adapting to the transformations experienced by modern society as a result of the widespread use of Information and Communication Technology (ICT). As a result, the so-called Justice 4.0 has emerged. This study analyzes the impact of the use of Information and Communication Technology (ICT) in the Brazilian Judiciary (PJ) and its parallel with Portuguese law. To achieve the desired objective, exploratory research was carried out in the literature and in government documents and websites, with an emphasis on legislation, using the deductive method, and in the end the comparison of related legislation was carried out. A comparative synthesis was then constructed. The analysis made it possible to draw up a table establishing the similarities found between the Brazilian and Portuguese civil procedure codes. It was found that both countries are committed to implementing ICT in their legal system and have numerous similar points in their procedural legislation. KEYWORDS: Judiciary.
