O direito à educação na prisão: um estudo sobre a oferta e o exercício do direito à educação no Presídio Estadual de São Luiz Gonzaga/RS

Resumo: | The right to education is considered a fundamental right for the development of the human being, it is an important right for the recognition of the individual as subject of rights, and for the exercise of other rights. In the prisons, the right to education plays an important role, especially in improving the quality of life of persons deprived of their liberty, in social insertion in the post-prison period, in the formation of citizenship and in the deconstruction and reconstruction of behavior and actions. The right to education integrates so-called public policies and is a constituent element of the development process as freedom, which is related to human development indices, and seeks to expand people's real freedoms and eliminate the main forms of deprivation of liberty. The right to education is provided for in the Constitution of the Federative Republic of Brazil as a social right, a right of all and a duty of the State. And, specifically for the population deprived of liberty, the right to education is provided for in the Criminal Enforcement Law as a right of the prisoner and a duty of the State. In this sense, considering the State's duty to enforce this right in prisons, it is sought to analyze how the right to education is offered in the São Luiz Gonzaga State Prison, based on the criteria of formal education, non-formal education, physical structure and structure of personnel. It seeks to analyze how this right is exercised by persons deprived of liberty in this place, according to the criteria of school demand and school achievement, accounting for the years 2016, 2017 and 2018. A research was conducted with a predominantly qualitative approach, with an exploratory and descriptive objective, with non-probabilistic sampling, and with the examination of documentary and audiovisual material. It was verified that the right to education is being offered in good conditions in the São Luiz Gonzaga State Prison school, in compliance with most of the legal precepts. However, at the same time, it was examined that there is no satisfactory exercise of the right to education by the persons deprived of their liberty in that place, there being a reduction in school demand in the years 2016, 2017 and 2018, and a low scholastic achievement of private persons of freedom during this period. |
