This study aims to present a discussion of research on the constitutional nature of human stem cells. It started to approach the theme with the elucidation of the difference between language and language to get the constitutional interpretation with emphasis on fundamental rights, and last about a stem cell research with a look of bioethics. Among these fundamental rights will be on the right to life that gravitarão fussabout and the conclusions of this work. From the discussion in the highest court of the country (STF) of when life begins, so that this decision was dismissed on the unconstitutionality of Direct Action (ADI N) in order to elucidate whether the research with human stem cells embryonic violates the right to life, and if there is violation of human dignity
