Summary: | The present dissertation is fruit of the studies developed in the Master course of the University of Passo Fundo (UPF), Rio Grande do Sul, Brazil, over biennium 2017-2018,made themselves by empirical observation the existence of failings on understanding the composition of political – economic - juridical during training of Brazilian Constitutional State. Developed, then, a study on concrete plan of evolution the spread of democracy, focused on the historical-institutional view their formation and of their matrix legal and comprising the constant legislative pursuit to upgrade the ripening process of social and political institutions. Argued that as to the democratization process in Brazilian society regained strength and visibility in recent decades and sought call the variants which shaped this institutional journey. Therefore, were worked hypotheses, that suggest construction of the financing of the campaigns electoral process in Brazil, the analysis of the evolution of inspection procedures implemented after the Federal Constitution of 1988, the “practical” framework of Our judicial and institutional regulatory and the composition of the " legitimating basis" that structure the democratic rule of law, measure the degree of efficiency of our democratic institutions.
