Summary: | This article explored the possibility of granting social security benefits to female victims domestic violence or stalking in the workplace. The lack of legal provision for the concession of social security benefits to women who need to take time away from the work environment as a result of family violence and frequent stalking was a problem observed. Furthermore, there were questions with regard to the worker's employment contract during the time period of her leave, if this would characterize a case of interruption or contractual suspension. The aim of the article, therefore, was to demonstrate, through bibliographical reviews and jurisprudential research, the need for a social security benefit, since the worker would not receive a salary during the absence from work, a period of physical and psychological recovery. |
